Terms & Conditions

Effective Date: April 1, 2025

1. Program Overview & Enrollment

By enrolling in the HolyShift Project, you agree to participate in a 12-month mentorship program that includes expert-led health and wealth coaching, personalized planning based on your data, daily execution support, and community accountability. You will also have access to $25,000+ in prizes and leaderboards.

2. Program Pricing & Payment

The program fee is $5,000 CAD for the first 10 clients who pay upfront, and $7,500 CAD thereafter. Monthly payment plans may be offered with a 12-month commitment required. You are responsible for maintaining a valid payment method for the full duration of the program. In the event of a payment dispute or chargeback, HolyShift reserves the right to suspend access until the issue is resolved. You remain liable for the full program fee regardless of participation status.

3. Refund Policy

You may request a refund within the first 30 days of enrollment. A $1,000 CAD administrative fee is non-refundable and covers onboarding, coaching time, and lab test setup. If you have not started any baseline assessments, such as lab tests or intake surveys, you may be eligible for a full refund. After 30 days, no refunds will be granted under any circumstances.

4. Results Guarantee

We stand behind this program with a clear ROI commitment. If you attend at least 80% of mastermind sessions, complete all required baseline assessments, and follow your assigned health and wealth roadmap consistently, and the program does not pay for itself through increased earnings, savings, or business growth, you may request a refund. A $1,000 CAD fee will still apply to cover administrative, coaching, and lab-related expenses. To qualify, you must provide documented proof of execution, including completed assignments, active participation, and consistent roadmap application. This guarantee is designed to protect committed participants and is only applicable if all conditions above are fully met.

5. Attendance & Engagement Requirements

Participants are expected to attend at least 80% of mastermind calls and choose one slot per week. Daily sessions include Group Performance Priming and Group Deep Work, with optional 1:1 coaching available. Full engagement is expected, and failure to participate may result in removal from leaderboard prizes or the program.

6. Testing, Baselines & Post-Assessments

Before the mentorship begins, you must complete all required onboarding, lab testing, fitness and nutrition assessments, and business metrics evaluations. At the end of the 12-month program, final post-assessments must be completed to track transformation and determine leaderboard rankings. Failure to complete final post-assessments disqualifies you from leaderboard prizes and final performance reviews.

7. Expectations & Code of Conduct

Participants are expected to show up on time, engage respectfully with mentors and peers, and follow their roadmap with integrity. Disruptive or non-engaged behavior may lead to removal from leaderboard prizes or the program.

8. Disqualification Grounds

You may be removed without refund for ghosting, toxic behavior, lack of effort, or violating confidentiality, IP, or competition clauses. In rare cases, if a participant is determined not to be a fit due to medical or mental health issues, inability to engage, or disruptive behavior, HolyShift reserves the right to remove them at its sole discretion. In such cases, a discretionary refund may be offered, minus a $1,000 CAD fee.

9. Confidentiality & Intellectual Property

All materials provided in the program, including documents, frameworks, templates, and videos, are proprietary and confidential. Participants may not reproduce, share, distribute, or create derivative programs using these materials. Participants are also prohibited from creating or promoting competing coaching programs using any part of the HolyShift framework for two years after program completion.

10. Pauses, Deferrals & Cancellations

There are no program pauses or deferrals. Cancellations are only permitted within the first 30 days per the refund policy. After 30 days, all payment obligations remain in effect.

11. Data & Privacy (PIPEDA Compliance)

HolyShift collects personal and health-related data to support custom coaching. This data is securely stored on Canadian or approved cloud platforms. Only program mentors and support staff have access to your personal data. You may request deletion, correction, or access to your data by contacting support. You may also withdraw consent at any time, though this may affect the ability to provide services.

12. Testimonials & Public Results

You grant permission for HolyShift to share anonymized or generalized versions of your progress, wins, or testimonials unless you opt out in writing. Any before/after statistics will be reviewed with you before public use.

13. Disclaimers

This program is not a substitute for licensed medical, legal, or financial advice. Any health, fitness, or supplement advice provided is general and not medical guidance. Any investment, crypto, tax, or financial discussions are examples or shared opinions only and should not be considered recommendations. You are responsible for your own decisions and results.

14. Force Majeure & Program Continuity

HolyShift is not liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to pandemics, government restrictions, economic collapse, natural disasters, platform outages, or mentor unavailability. If circumstances prevent fulfillment of program elements as designed, reasonable efforts will be made to deliver equivalent value, but refunds will not be issued beyond the existing policy. If the program is canceled due to low enrollment (fewer than 15 participants), HolyShift will issue full refunds to all enrolled participants.

15. Non-Disparagement Clause

Participants agree not to publicly make statements—written, verbal, or digital—that may harm the reputation of HolyShift Project, its founders, team, or fellow participants. Feedback should be delivered constructively and privately through appropriate channels.

16. Dispute Resolution & Governing Law

All disputes must first be resolved through mediation within Ontario, Canada. If unresolved, any legal claims must be brought exclusively to the courts of Ontario under the governing laws of the Province of Ontario. Participants waive their right to participate in any class action lawsuit against HolyShift Project, its affiliates, or team members.

17. Agreement Confirmation

By submitting payment and enrolling in the HolyShift Project, you acknowledge that you have read, understood, and agree to all terms listed above.
